(AP) ? Newtown celebrated Christmas amid piles of snow-covered teddy bears, long lines of stockings and heaps of flowers as volunteers manned a 24-hour candlelight vigil in memory of the 20 children and six educators gunned down at an elementary school just 11 days before the holiday.

Well-wishers from around the country showed up Christmas morning to hang ornaments on a series of memorial Christmas trees while police officers from around the state took extra shifts to direct traffic, patrol the town and give police here a break.

"It's a nice thing that they can use us this way," Ted Latiak, a police detective from Greenwich, Conn., said Christmas morning, as he and a fellow detective, each working a half-day shift, came out of a store with bagels and coffee for other officers.

The expansive memorials throughout town have become a gathering point for town residents and visitors alike. A steady stream of residents, some in pajamas, relit candles that had been extinguished in an overnight snow storm. Others took pictures, dropped off toys and fought back tears at a huge sidewalk memorial in the center of Newtown's Sandy Hook section that is filled with stuffed animals, poems, flowers, posters and cards.

In the morning, Newtown resident Joanne Brunetti watched over 26 candles that had been lit at midnight in honor of those slain at Sandy Hook Elementary School. She and her husband, Bill, signed up for a three-hour shift and erected a tent to ensure that the candle flames never went out throughout the day.

"You have to do something and you don't know what to do, you know? You really feel very helpless in this situation," she said. "People have been wonderful to everybody in Newtown whether you were part of what happened or not. My thought is if we were all this nice to each other all the time maybe things like this wouldn't happen."

At a town hall memorial, Faith Leonard waved to people driving by and handed out Christmas cookies, children's gifts and hugs to anyone who needed it.

"I guess my thought was if I could be here helping out maybe one person would be able to spend more time with their family or grieve in the way they needed to," said Leonard, who drove to Newtown from Gilbert, Ariz., to volunteer on Christmas morning alone. "I know they've been inundated with support and that's great, but it's always nice to have a present to open on Christmas day."

Julian Revie played "Silent Night" on a piano on the sidewalk at the downtown memorial. Revie, from Ottawa, Canada, was in the area visiting at the time of the shootings. He cancelled his plans to go to Australia, found a piano online and chose to spend Christmas Eve and Christmas Day playing for the people of Newtown.

"It was such a mood of respectful silence," said Revie, who planned to leave the piano behind. "But yesterday being Christmas Eve and today being Christmas Day, I thought now it's time for some Christmas carols for the children."

Many town residents attended Christmas Eve services Monday evening and spent the morning at home with their families. Others attended church services in search of a new beginning.

At St. Rose of Lima Roman Catholic Church, which eight of the child victims of the massacre attended, the pastor told parishioners that "today is the day we begin everything all over again."

Recalling the events at Sandy Hook Elementary School on Dec. 14, the Rev. Robert Weiss said: "The moment the first responder broke through the doors we knew good always overcomes evil."

"We know Christmas in a way we never ever thought we would know it," he said. "We need a little Christmas and we've been given it."

Police have yet to offer a theory about a possible motive for gunman Adam Lanza's rampage on Dec. 14. The 20-year-old Newtown man, who lived at home, killed his mother in her bed before carrying out the massacre at the elementary school, then killing himself.

Most businesses were closed for the holiday and the heavy traffic near memorials that has been ever present since the shootings largely disappeared for the day. Still, a steady stream of out-of-state vehicles passed by, with many passengers taking pictures of the memorials from their cars. Some stopped to get out and contribute to them.

Philadelphia resident Ed Sison brought his wife and 9-year-old son to Newtown on Tuesday while they were on their way to see family in Massachusetts. They decorated memorial trees with ornaments and beads, among other things.

"It's an event that just touches us all. We have a young son and you know we all feel the pain," he said.

Wanting to join...


Hi LoTRO team! I had tried this game before but couldn't really get into its apparent unresponsiveness to my mouse. However, I just reinstalled it to give it another go. There's just one problem: all the names I normally use are taken! This makes me a sad sith. But I will work on coming up with new ones.

Two questions until that happens:
1. I use a Razer Naga. Is there any way I can make the game "warm up" to mouse movement? Granted I was on a laptop last I tried it, but I don't think that would be too big an issue. I'll also check Razer's site if there is anything they have.

2. Are there options regarding graphics I can change? I have a 27" monitor and the game only takes up about half the resolution, if that.

Any help with that would be much appreciated, and I hope to be in-game soon!

Three-nation crew blasts off for space station

ALMATY (Reuters) - A Soyuz spacecraft carrying a Russian, an American and a Canadian blasted off on Wednesday to the International Space Station (ISS), where the men are to spend half a year in orbit.

The Russian-built Soyuz TMA-07M lifted off on time, at 1212 GMT, from Russia's Baikonur cosmodrome in Kazakhstan.

On the crew's two-day trip to the ISS, Canadian Chris Hadfield is joined by U.S. astronaut Tom Mashburn and Russian cosmonaut Roman Romanenko.

They will join U.S. astronaut Kevin Ford and Russians Oleg Novitsky and Yevgeny Tarelkin, who have been manning the $100-billion, 15-nation research complex since October.

The Wire at Ten? Jonathan Simon, Wiring in the Empirical | Points ...

Editor?s note?Jonathan Simon is the Adrian Kragen Professor of Law at UC Berkeley, where he teaches classes on criminal law and socio-legal studies. Simon is the author of multitudinous law review and criminology articles as well as several monographs, including Governing through Crime: How the War on Crime Transformed American Democracy and Created a Culture of Fear (Oxford University Press, 2009), and the forthcoming Mass Incarceration on Trial: America?s Courts and the Future of Imprisonment (New Press 2013). Simon?s post today closes out our series on HBO?s The Wire with a consideration of the overlaps?and gaps? between the show?s narrative ?realism? and the empiricism that goes by that name in the contemporary legal academy.

The popularity of HBO?s The Wire among legal academics ? especially scholars of criminal law?responds to the same transformations in the legal field that have made empirical studies increasingly influential there.? But might the satisfaction of getting ?realism? from a DVD (or download) deter a scholar from trading the couch for the backseat of a police car?

This is What Empiricism Looks Like

Empirical knowledge about law is enjoying unprecedented prestige in both law schools and courts. These days, top candidates for academic law teaching jobs frequently show up at faculty interviews with their lap-tops loaded up with regression tables, scatter-plots with lines fitted, a nifty difference of differences tests.? If they get pushed by the audience, it is likely because someone thinks they should have used a different form of multivariate analysis.? It is ok for someone to ask them to articulate the normative pay off of their analysis, law professors are supposed to do that, but not to bother them with the meaning of a series of Supreme Court precedents they might or might not have read.? And it is not only quantitative research that is displacing philosophical conundrums and doctrinal searches for principle from the pages of the nation?s law reviews: ethnography, qualitative interviews, and discourse analysis are also making their mark on a field once known for ?black letter[s].?

It is in the context of this empirical moment of legal knowledge that we might appreciate the wide appeal of The Wire among law professors, who have discussed it in thirteen law review articles and many other journals and book chapters since 2009, including a symposium in the Ohio State Journal of Criminal Law.? The show?s following among professors of criminal law and procedure reflects the degree to which, for scholars of criminal law and justice in particular, The Wire has filled a real need for an empirical object of analysis that has remained frustratingly absent even as the war on drugs and mass incarceration has pushed them to go beyond case law and statute.? In this post I want to suggest transformations of the legal field that have given rise to a desire for an empirical object, even one that has to be largely imagined. These transformations include:

The Primacy of Policy
The question of whether a particular reading of the law is correct has always fascinated lawyers; what has changed at the turn of the century is the degree to which this question had merged with the question of whether that particular reading will lead to good public policy.? With the rise of law and economics this has included not just public areas of law, like criminal or constitutional law, but also classic private areas of law.? Indeed, some orthodox economists have argued that welfare gains (economist talk for policy outcomes) are the only consideration appropriate to law.

Twenty years ago when I started teaching, the idea that criminal laws and justice agencies operated in a wholly different manner for young men of color in urban neighborhoods than for suburban whites was still largely ignored by casebooks. Today that background has come into the foreground.? The idea that mass incarceration is a new Jim Crow (as the title of Michelle Alexander?s best-selling book about the racial character of criminal law enforcement makes clear), is today widely recognized by law professors and many if not most of their students.? The idea that the disproportionate racial impact of arrest and incarceration policies has undermined the effectiveness and legitimacy of our criminal justice system is also becoming a new common sense, as brilliantly expressed in the late William Stuntz?s posthumously published The Collapse of American Criminal Justice (2011).

The Wire aired during the decade when what my colleague Frank Zimring calls The Great American Crime Decline was becoming visible.? It created a rich, albeit fictional information environment in which the gathering critique of mass incarceration on sociological grounds could be documented and its relationship to the machineries of justice made visible.? After all, the other narrative, the one in which criminals are rational bad actors making real and morally salient choices in a landscape of freedom and personal effectiveness has long been promoted by popular police television shows.? As legal scholar Bennett Capers wrote in the introduction to the Ohio State Journal of Criminal Law symposium:

Law and order shows, especially the ones that give the illusion of being police procedurals, are uniquely positioned to critique this justice. Law and order shows, at their best, bring out of the shadows the justice that actually exists. No show does this better than The Wire.

"A Great Moment of Civic Compromise"

?A Great Moment of Civic Compromise?

For legal academics, who want not just to understand the failure of contemporary crime policies but to promote alternatives to them, The Wire offered up experiments unavailable in even the most progressive cities.? If the war on drugs was generating a lucrative industry of arrest and incarceration without? bringing peace or dignity to the streets of Baltimore (or any other large American city), what would happen if police allowed the drug markets to operate in the open on an agreement to operate without violence and to keep it out of sensitive areas?? Season 3?s ?Hamsterdam? episodes, when a frustrated police commander decides to run that experiment, represented a socio-legal public policy experiment as rogue police operation, itself a biting critique of what remains the official drug war criminology of the federal government and most criminologists.

New Technologies and the Ability of Law to Govern Society
The empirical turn in law has tracked alongside the rise of new technologies, especially the personal computer and telecom, that have transformed the economy and fundamentally reordered both the way legal rules touch on people?s lives and the capacity of law enforcers to know and act on them.? Throughout its five seasons, The Wire managed to make the technologies through which police and drug dealers watch each other and communicate a persistent theme.? The title?s evocation of wiretapping links the show to the recent pre-digital past, in which a great deal of our criminal procedure around policing was developed in the 1960s and 1970s.? As Season 2 revealed, the rapid spread of cell phones among drug dealers (and other young people) was making the wiretap, one of the stronger points of judicial control over police action, increasingly irrelevant.? Season 3, which brought us back to a close look at the Barksdale organization under Stringer Bell, included memorable scenes of Stringer at his laptop running Business School-like applications to improve his drug distribution business.? Throughout the series, the title sequence showing the surveillance camera capturing its own damage by a rock was a reminder of the vulnerabilities of law enforcement that relies on technologies of surveillance rather than real communication between police and the communities they are supposedly making safer.

Crime and Punishment
Crime, and the social response to crime, has long been taken as a proxy for the basic American attitude toward law.? The proliferation of alcohol-trafficking related crime in the 1920s after national prohibition, and the resulting increases in imprisonment and the growth of new enforcement agencies, helped stimulate the first great wave of interest in empirical research among legal academics, known as ?legal realism.?? Since the 1990s both the significant rise of the prison population and its connection to intense policing of drug sales, especially in low income minority majority neighborhoods, has grown as a significant concern among legal scholars. Since the end of that decade, this has been joined by the question of what caused the substantial nationwide drop in crime that began early in the 1990s and has so far leveled off but not been reversed. (On this point, in addition to Zimring?s book noted above see The City that Became Safe: New York?s Lessons for Urban Crime and Its Control [2011].)

The Wire was produced during years when the crime decline was becoming visible? to criminologists but had not yet begun to really influence thinking about criminal justice policy. Its basic message, that there is little we can do to arrest our way out of the toxic tangle of inequality, mistrust, and violence in high crime urban neighborhoods, needs little revision.? Whatever the best police departments managed to do in the mid-1990s to drive down crime, it was not happening in either the real or the fictional Baltimore, and still has yet to happen in many cities across the United States.? In keeping the focus on police failure, The Wire helped solidify what has become a new common sense among academic criminal law experts, namely that aggressive enforcement of drug laws targeting the young men most often recruited to be the exposed element of drug distribution networks cannot create more secure neighborhoods.

Serving the Public Good, the Western District Way

Empiricism from the Couch
I have suggested that popularity of The Wire among criminal law academics reflects its fit with broader transformations in law and society that have made empirical knowledge about law more salient then ever before. The Wire was based on both good journalism grounded in local knowledge of Baltimore, and the best available sociology, grounded in William Julius Wilson?s understanding of America?s urban crisis, so it is perhaps a reasonable substitute for the robust empirical research on contemporary urban policing that is much needed but still relatively rare.? Half a century ago, the publication of Jerome Skolnick?s Justice Without Trial (now in its third edition), helped launch both an academic industry in ethnographic studies of policing, and a popular culture shift toward realism in the portrayal of police procedurals on television.

Today The Wire has not so much displaced Skolnick as helped make up for the absence of? social science empiricism on policing. ?While a flood of statistics about the performance of criminal justice agencies are now readily available, qualitative knowledge of how those agencies actually operate on citizens, especially through policy, remain rare and subject to the whim of local officials. ?A strong indicator of that is the tremendous reception among criminal law scholars of Richard Leo?s definitive empirical study of how police coerce confessions, Police Interrogation and American Justice.? Leo, a student of Skolnick?s, demonstrates the continuing demand for empirical knowledge of police practice?a demand that has been, if anything, primed rather than diminished by watching The Wire.

Here's your chances for a white Christmas and a dry New Year's Eve in the U.S.

Dec. 18, 2012 ? Samantha Borisoff is a climatologist in Cornell University's Department of Earth and Atmospheric Science and at the NOAA-supported Northeast Regional Climate Center. She examined 50 years of weather data and calculated the chances for a white Christmas and a dry New Year's Eve for various cities throughout the United States. Here's what she found:

Borisoff says: "For those dreaming of a white Christmas, it's practically guaranteed in Fairbanks, Alaska, where there has been an inch or more of snow on the ground every Christmas for the past 50 years. What about the contiguous U.S. you ask? There's a 96 percent chance of celebrating the holiday in a winter wonderland in Duluth, Minn.

"In the Northeast, it'll be lovely weather for a sleigh ride together in Pinkham Notch, N.H., where there's a 95 percent chance of an inch or more of snow on the ground on the 25th. And as for New York, Watertown's where it's at; the snow that is! The city has a 76 percent chance of having a white Christmas.

"If you're looking to stay dry while ringing in the New Year, gamble on Las Vegas, where there's only a 2 percent chance of measurable precipitation. Coastal hotspot Miami may have a lot of water nearby, but it shouldn't have much falling from the sky on New Year's Eve with only an 18 percent chance of precipitation.

"How does the ultimate destination, New York City, fare? Well, there's a 46 percent chance it'll rain, or snow, on your New Year's Eve celebration in the Big Apple."

Ireland to legislate for life-saving abortions

(AP) ? Ireland's government says it will draft a new law spelling out the right of women to receive abortions in cases where the pregnancy poses a risk to their lives ? including from a woman's own threats to commit suicide.

For two decades, successive governments have resisted passing any law in support of a 1992 Supreme Court judgment that such abortions should be legal in Ireland.

Catholic conservatives particularly oppose the suicide-threat justification, arguing it could be used to expand access to abortion beyond relatively rare cases where a pregnancy endangers a woman's life.

Tuesday's announcement follows international uproar over the October death of a miscarrying Indian woman in an Irish hospital.

Her widower said she was denied a prompt termination because the fetus had a heartbeat.

Jules Bianchi, who has participated in the Young Driver Test this year, has a strong chance to get a race seat at Force India in the 2013 Formula 1 season, according to his manager, Nicolas Todt.

Bianchi acted as a reserve driver for the Silverstone based squad in 2012 and performed impressively well in this year?s Young Driver Test.

There have been many names which are linked with Force India for the next season which mainly include Adrian Sutil, Bruno Senna and Kamui Kobayashi.

However, Todt has recently said that Bianchi is the strongest contender to secure a race seat alongside Paul di Resta in the coming year. Furthermore, he said that there are only two to three people in Force India who are going to make the final choice regarding their next year?s driver line-up.

?The decision is in the hands of two or three people at the Force India team,? Todt, the manager of Pastor Maldonado of Williams and Felipe Massa of Ferrari and the son of FIA president Jean Todt, said.

Even though, he expressed that the 23-year-old has a real chance to race with Force India in the next year, but insisted that nothing has been finalised yet.

?I think Jules has a real chance but nothing is done,? added Todt.

Additionally, when he was asked about the Sutil?s chances of securing a race seat at Force India, he asserted that presently there are many drivers who are in the consideration list and doubts the possibility of the German driver to get the post.

?There are many drivers knocking on the door at Force India. I would be surprised, but as of today I do not think anyone has signed,? said Todt.

It will be important to mention that Force India are the first contender who have announced to unveil their 2013 car on February 1 at Silverstone circuit just before the first pre-season test which is to be held at Jerez on February 5.

Besides, they are planning to make the most out of the winter testing to attain better results in the next season.

Obama backs off hard lines in search of compromise

WASHINGTON (AP) ? Narrowing a "fiscal cliff" negotiating gap, President Barack Obama is backing off what had once been ironclad positions.

A new proposal handed to House Speaker John Boehner on Monday drops Obama's long-held insistence that taxes rise on individuals earning more than $200,000 and families making more than $250,000. He is now offering a new threshold of $400,000 and lowering his 10-year tax revenue goals from the $1.6 trillion he had argued for a few weeks ago.

Obama also abandoned his demand for permanent borrowing authority. Instead, he is now asking for a new debt limit that would last two years, putting its renewal beyond the politics of a 2014 midterm election.

And in a move sure to create heartburn among some congressional Democrats, Obama is proposing lower cost-of-living increases for Social Security beneficiaries, employing an inflation index that would have far-reaching consequences, including pushing more people into higher income tax brackets.

"Any movement away from the unrealistic offers the President has made previously is a step in the right direction," Boehner spokesman Brendan Buck said. "But a proposal that includes $1.3 trillion in revenue for only $930 billion in spending cuts cannot be considered balanced."

Either way, though, there is no doubt Obama has moved in Boehner's direction after Boehner opened the door to a tax rate increase.

Obama's plan, like Boehner's, would also raise taxes on dividends and capital gains from 15 percent to 20 percent. Both would also reduce the number of deductions and exemptions that wealthy taxpayers can claim. Obama's proposal also would let estate taxes revert to 55 percent on estates after allowance for a $1 million exemption.

In making his offer, Obama stiff-armed Republican demands to increase the eligibility age for Medicare from 65 to 67, a goal Democrats strongly reject. He also sought to contain cuts in Medicare and other health care programs to about $400 billion over 10 years, less than what Republicans want. And he is continuing to seek spending on unemployment assistance and on public works projects.

Obama's willingness to reduce future cost-of-living increases in Social Security would also mean smaller annual increases in government pensions and veterans' benefits. Annual adjustments to income tax brackets would be smaller, pushing more people into higher tax brackets.

Over time, because annual adjustments to the poverty level would be smaller, the new index could reduce the number of people eligible for programs such as Medicaid, Head Start, food stamps, school lunches and home heating assistance.

To avoid some of that risk, Obama wants lower-income recipients to receive protection against any loss from scaling back future cost-of-living increases, people familiar with his plan said.

Apollo to invest Rs 400 cr on 10 cancer, heart hospitals

Healthcare major Apollo Hospitals said it will invest Rs 400 crore to set up 10 specialised hospitals in India by 2015 for treatment of heart diseases and cancer. "We will set up ten specialised hospitals at an investment of Rs 40 crore per hospital. These hospitals will be operational by 2015," Apollo Hospitals Group Chairman Prathap Reddy told PTI.

Out of the total, five will be focused on treatment of heart diseases and the other five on cancer treatment. These will be in addition to the group's plans of adding 2,000 beds. "All these 10 hospitals will have between 50-75 beds each. For these hospitals, we are looking at locations like Chennai, Ahmedabad, Kolkata, Delhi, Varanasi," Reddy added.

Last year, the healthcare major had announced it would add 2,000 beds in 24 months entailing an estimated investment of nearly Rs 1,200 crore. At present the group is one of the largest healthcare chains in Asia with over 8,500 beds across 50 hospitals.

Who likes bling? The answer relates to social status

Dec. 17, 2012 ? A desire for expensive, high-status goods is related to feelings of social status -- which helps explain why minorities are often attracted to bling, a new study suggests.

Previous research had shown that racial minorities spend a larger portion of their incomes than do whites on conspicuous consumption -- buying products that suggest high status.

But a new study showed that whites could be induced to crave expensive, high-status products if they imagined themselves in a low-status position.

These findings cast doubt on the notion that urban minorities have developed a corrosive "bling culture" that is unique to them, said Philip Mazzocco, lead author of the study and assistant professor of psychology at Ohio State University's Mansfield campus.

"Minorities don't buy high-status products because of some 'bling culture.' It is a basic psychological tendency that we all share when we're feeling inferior in some part of our life," Mazzocco said.

"Anyone who is feeling low in status is going to try to compensate. And in our capitalistic, consumption-oriented society, one way to compensate is to buy high-status products."

Mazzocco conducted the study with Derek Rucker, Adam Galinsky and Eric Anderson of Northwestern University. The findings appear in a recent issue of the Journal of Consumer Psychology.

For the study, the researchers conducted several related experiments.

In the first experiment, 146 American adults -- about half white and half black -- were told they would be participating in a study of consumer preferences. They were asked to rate how positively or negatively they viewed 10 products on a nine-point scale from "extremely negative" to "extremely positive."

Five of the products had been rated by a separate group of people as high in status (fur coat, cuff links, caviar, an Italian suit and Italian loafers), while five were rated as relatively low in status (vacuum cleaner, sofa, refrigerator, washing machine and an unbranded shirt).

The study found that, overall, blacks had more positive evaluations of the high-status products than did whites. But more importantly, blacks who considered their race to be an important part of their identity rated high-status goods higher than did blacks who had lower racial identification.

There was no such difference among whites in the study.

"Because African Americans are seen as lower in status in our society, those who identify more strongly with being black are more likely to compensate by seeking high-status goods," Mazzocco said.

A second study provided more evidence of the role that status plays in conspicuous consumption. In this experiment, 117 white college students were asked to write a story in which they imagined themselves as a character with certain demographic characteristics.

In all cases, the demographic characteristics -- including income -- remained the same. But half of the students were asked to imagine their character was white, and half were told their character was black.

Afterward, the participants were asked to rate the desirability of high-status and low-status products. Findings showed that the white students who imagined themselves as a black character rated the high-status products as more desirable than did the white students who imagined themselves as white characters.

"We called this vicarious conspicuous consumption. White students who temporarily identified with a low-status racial group showed an increased desire for high-status products," Mazzocco said.

The findings don't relate only to race, he said. Another study showed that other situations involving status can affect how people feel about conspicuous consumption.

In this experiment, 50 white adults were again asked to write a story imagining themselves as a specific character. In this case, the character was always described as being white. But in half the cases the character was a janitor (a low-status job) and in the other half the character was a brain surgeon (a high-status job).

The findings were clear. Participants who imagined themselves as a janitor had more positive evaluations of high-status products than did the participants who imagined themselves as brain surgeons.

In a final experiment, 69 white adults wrote a story in which they imagined themselves as a white or black character. In this case, they rated their desire to own or purchase specific high- and low-status products. They were then asked to rate the level of social status of the character they wrote about, on a scale of 1 to 10.

In this case, the participants who wrote about the black character were more likely to say they wanted to purchase the high-status products, similar to findings in the earlier studies. And they also rated their character as having lower social status than did the participants who wrote about a white character.

"This provides additional evidence that it is a perception of having low status that is driving the increased preference for high-status products," Mazzocco said.

"It suggests that people don't like being in a low-status situation, and they compensate for that by trying to acquire high-status products."

Mazzocco said having this knowledge may help people as they're shopping.

"If you're in a store and find yourself craving an expensive 60-inch flat-screen TV, think about why you want it. It may not be because of the positive attributes of the TV, but because you have a feeling of low status in some part of your life at that time.

"Think about parts of your identity where you excel. Maybe you're a good father or mother, or a good student or a good friend. There are many parts to our identity, and it may help to call to mind parts where we feel we have higher status when we're shopping."

Mazzocco said future studies will examine whether people can resist conspicuous consumption when they call to mind parts of their lives where they feel they have high status.

Steel firm settles religious accommodation suit ? Business ...

Pittsburgh-based steel-industry supplier Magnetics International will pay $30,000 to settle a religious discrimination suit filed by an employee in Indiana who claimed the company failed to accommodate his need to worship regularly.

At the time Daniel began working as a laborer at the company, he explained that his Christian beliefs required him to attend church at least every other Sunday. Magnetics agreed to the arrangement, but Daniel?s religion became a polarizing issue.

When the company scheduled him to work on two consecutive Sundays, he reminded his employer of the conflict it would cause. According to Daniel?s complaint, Magnetics insisted he had to work as scheduled and offered no other possible accommodations. Daniel refused to work the second Sunday, and he was fired.

He filed a complaint with the EEOC, which tried to mediate the dispute. When those efforts were unsuccessful, it sued on Daniel?s behalf. Only then did Magnetics offer to settle.

Under the settlement, Magnetics must pay Daniel $30,000 and respond appropriately to all requests for religious accommodation for the next three years. The terms of the settlement also require the company to post a nondiscrimination policy, provide employee training and regularly report its compliance efforts to the EEOC.

Advice: Once you make an accommodations deal with an employee, stick with it. Changing the terms later can easily provoke a lawsuit.

Find comes almost exactly a century after site was abandoned

A National Science Foundation-funded research team working on the slopes of the world's southernmost active volcano appears to have found the remains of a camp used by explorers of the so-called "Heroic Age" of Antarctic exploration, a century after the camp was abandoned.

Although photos of the site, known as "the highest camp", appear to match an archival photograph taken by members of the 1912 Terra Nova expedition led by Royal Navy Captain Robert F. Scott, conservators from the New Zealand-based Antarctic Heritage Trust have been asked to verify the historic find.

The find comes in the closing days of the centennial of the so-called "Race to the Pole" between Scott and Norwegian Roald Amundsen. Amundsen reached the geographic South Pole on Dec. 14, 1911, five weeks before Scott's party. In the tragic finish to the race, Scott and his men perished on the ice on their return trip, only a few miles from safety.

A ring of stones, where a tent once stood in what may have been a Terra Nova campsite, was discovered by Clive Oppenheimer, a volcanologist at Cambridge University in the United Kingdom. Oppenheimer is working on Mt. Erebus, a 14,500-foot, ice-covered volcano, as part of a team of NSF supported researchers led by Phillip Kyle of the New Mexico Institute of Mining and Technology.

With support from NSF, Kyle has been studying Mt. Erebus for decades. The volcano is unique in the world, not only because of its location, but also because of other features, notably a lake of lava deep in the ice-covered crater.

Oppenheimer is the first known visitor to the site since Scott's men left. He found it using a combination of written accounts and historic images from the Scott Polar Research Institute in Great Britain, which was founded by one of the party that climbed the volcano in 1912.

Although Oppenheimer is working on Erebus as a member of a team supported by the U.S. Antarctic Program, which is managed by NSF, he found the site during a break in the research work.

NSF is taking steps, along with international partners New Zealand and the U.K., to insure that the archeological value of the site is maintained.

A survey will record the area and search for items that may have been left behind in 1912.

A number of the Heroic Age huts used by explorers such as Scott and Sir Ernest Shackleton in the early years of the 20th century, have similarly been preserved and contain a wide range of artifacts--from scientific equipment to expedition supplies--that have been extraordinarily well preserved by the extremely cold and dry Antarctic climate.

Records show that a camp was erected in 1912 by a team from the shore party of the Terra Nova Expedition that climbed Mt. Erebus. This was the second group to examine the summit region of Mt Erebus. A group from Shackleton's Nimrod Expedition (1907-1909), including famed Australian geologist Sir Douglas Mawson, was the first to climb Erebus and observe the active lava lake in 1908.

The team that camped at this site was led by geologist Raymond Priestley and included Tryggve Gran, a Norwegian ski specialist; Frederick Hooper, formerly a steward on the Terra Nova; Royal Navy Able Seaman Harry Dickason; Petty Officer George Abbott and geologist Frank Debenham. They undertook mapping and collected geological specimens.

It was during his time on Mt. Erebus that geologist Frank Debenham had the idea of a "Polar Research Institute." After serving in World War I, Debenham was named the founding director of the University of Cambridge's Scott Polar Research Institute.

Philippe Foster Back, granddaughter of Frank Debenham and chair of the United Kingdom Antarctic Heritage Trust, said "Clive Oppenheimer's location of the original 'highest camp' is a wonderful addition to all the activity which has taken place throughout 2012 to mark the centenary of Captain Scott's expedition. It is a reminder of both the dangers and thrills of Antarctic science and a fitting tribute to the great legacies of exploration and discovery left to us by all the brave men of that party."
